Due Dilligence in Cyberspace

My interest, recently, was sparked by the hacking state. More often than not states do not just passively collect intelligence, they seem, increasingly, to be employing network based attack strategies to break in and retrieve information. Other sates – it is suspected, to say the least – readily resort to the use of hacking as a means to distort infrastructure in another state.
The questions this raises for international law are numerous, but it all begins with a base line. That is: if a state actor uses relatively anonymous means to distort or access information in an other state: which responsibility does the state where the attack originates have? And in practical terms: how can this even be determined?

The major question is twofold: what are the due dilligence requirements of states in international law (also in relation to evidence gathering). And what could be the norms for states in such conflicts? Could this start a war? I hope not (and so do others)!

In light of this ongoing debate, I thought it was useful to post a link to a number of articles I was reading on this – for your elaw enjoyment. They are linked in the text above. Perhaps a next step would be to open a forum discussion on this topic: the more elaw enjoyment, the better, don’t you agree?

eLaw Open Minded 2016

On April 1 (12:00 -13:00) we will kick off  the next round of “Open Minded” lunch lectures. You are welcome to join us at the first session with Dr Bart Custers speaking about threats and challenges of virtual currency – bitcoins.

Invitation eLaw Alumni: December 1

We are happy to invite you to the first meeting of the eLaw Alumni Vereniging on Tuesday December 1st at 17:30. Please register on this page (click here).

The meeting starts at 17:30 with drinks and bites. The meeting starts at 18:00. After the meeting and the presentations the room wil be open until 22:00.

Dear members, as we announced last year we have created an elaw alumni association, established our board and have set the long awaited date for our first meeting. Since we are still discussing the venue and the location we ask you to save the date!

Symposium and eLaw Alumni

On april 1st 1985 the Centre for Law and Digital Technologies: eLaw was established. To celebrate the 30th anniversary the center will organise a symposium on wednesday the 1st of april 2015.

We hope you will all join in this celebration!

Of particular note to eLaw alumni is the reception hosted afterwards at Koetshuis de Burcht (Burgsteeg 13, 2312 JR Leiden in the “bovenzaal”). Aernout Schmidt, the founder of “Recht & Informatica”, will provide a unique overview of “30 years of eLaw”, after which the eLaw Alumni Association will be founded and introduced. All speakers, visitors and alumni are wholeheartedly invited to join us shortly after 17:00.

This is the website for the eLaw Alumni Association. Parts of this website are only accessible to registered members.

The eLaw@Leiden Alumni association has three general goals: it assures eLaw@Leiden of contact with it’s expert alumni network for the purposes of research, education and contact with the information society we live in. It assures eLaw alumni of an easy way to stay in touch with eLaw@Leiden for their own varied purposes. And, last but not least, it provides a platform for information exchange and social activities.

Membership of the eLaw Alumni Association is open to:

  1. Former and current employees of eLaw@Leiden
  2. Those otherwise related to eLaw@Leiden (This can be due to PhD reasearch and/or promotions, professional relationships, thesis students and/or masters students in various courses)

Memberships based on the second category are awarded at the discretion of the board.

eLaw alumni are free to add posts and comments to both public and private eLaw Alumni Sites. The private parts of this eLaw Alumni Site can only be seen by alumni.

As quite a few eLaw alumni are non-native Dutch speakers and many native Dutch speakers do command some English, the choice of language between Dutch an English is context dependent and free in principle. As your webmasters are limited in time and resources, the main website is maintained in English, which is the preferred interface language.
