Dear all, since this will be a uniquely Dutch topic the following is in Dutch:

Op vrijdag 16 maart organiseren de eLaw-alumnivereniging en het centrum eLaw van de Universiteit Leiden een actualiteitencollege vanwege het zogenoemde ‘Sleepwetreferendum’.
Dit college helpt om door de bomen het bos te zien over betreffende wet, de nieuwe Wiv 2017 (Wet op de inlichtingen- en veiligheidsdiensten 2017). He actualiteitencollege is voor een ieder toegankelijk.

Datum en tijd: 17.00 uur (klokke) tot 18.45 uur.
Locatie: Kamerlingh Onnes Gebouw, Steenschuur 25, 2311 ES Leiden.
Zaal: Lorentzzaal, A1.44.

Programma:
1. Jan-Jaap Oerlemans – Algemene inleiding Wiv 2017: een technologisch gedreven wet (15 min) Jan-Jaap Oerlemans is als onderzoeker verbonden aan eLaw, het Centrum voor Recht en Technologie van de Universiteit Leiden.

2. Ronald Prins – De Wiv 2017 vanuit technisch perspectief 2017 (10 min) Ronald Prins is oud-directeur en oprichter van Fox-IT. Hij is lid van de nieuwe Toetsingscommissie Inzet Bevoegdheden van de nieuwe Wiv 2017, daartoe voorgedragen door de Tweede Kamer.

3. Gerrit-Jan Zwenne – Recht op privacy en de Wiv 2017 (10 min) Gerrit-Jan Zwenne is hoogleraar recht en de informatiemaatschappij bij eLaw, het Centrum voor Recht en Technologie van de Universiteit Leiden. Daarnaast hij advocaat bij Brinkhof N.V. te Amsterdam.

4. Ton Siedsma – het belang van digitale grondrechten en de Wiv 2017 (10 min) Ton Siedsma is onderzoeker bij Bits of Freedom. Hij zet zich in voor een betere controle op overheidshandelen en wil zorgen dat er geen inbreuk wordt gemaakt op onze digitale grondrechten, tenzij daar hele goede redenen voor zijn.

5. Vraag & Antwoord en Paneldiscussie o.l.v. Bart Schermer tot uiterlijk 18.45 uur Bart Schermer is als universitair hoofddocent verbonden aan eLaw, het Centrum voor Recht en Technologie van de Universiteit Leiden en partner bij Considerati.

Voor de sprekers en de aanwezige elaw-alumni is er na afloop van het college in de “Huiskamer” van Café de Keyzer (’t Keizertje, Kaiserstraat 2-4, 2311 GR Leiden) gelegenheid om nog na te praten onder het genot van drank en een macaronimaaltijd (ook vegetarisch).

I. Jan Jaap Oerlemans, who will speak about his dissertation entitled “Investigating Cybercrime”;

Mr. dr. Jan-Jaap Oerlemans heeft zijn bachelor rechten afgerond aan de Universiteit Leiden en de masters strafrecht en informatierecht gedaan bij de Universiteit van Amsterdam. Bij eLaw is hij van 2008-2010 student-assistent geweest van Franke en sinds 2010 geeft hij gastcolleges over cybercrime en jurisdictie bij verschillende keuzevakken. Op 10 januari 2017 is hij gepromoveerd op zijn proefschrift ‘Investigating Cybercrime’ bij de Universiteit Leiden. Hij zal tijdens de alumni-avond over de resultaten van zijn proefschrift vertellen.

II. Lourens la Roi, who will speak on how E-law influences his career today;

Mr. L.H. la Roi (Lourens) studeerde in 2001 af bij toentertijd Recht & Informatica (nu eLaw@Leiden). Sindsdien heeft hij bij verschillende overheidsinstanties gewerkt, steevast op het snijvlak tussen recht en ICT. Bij de Onafhankelijke Post en Telecommunicatie Autoriteit hield hij zich bezig met het toezicht op het verbod van spam en spyware en met de specifieke regels uit de Telecommunicatiewet voor het verwerken van persoonsgegevens (denk aan de regels voor telefoongidsen en regels voor nummeridentificatie). Bij het Ministerie van Binnenlandse Zaken hield hij zich bezig met de Wet op de Inlichtingen- en Veiligheidsdiensten en het telecommunicatiegeheim. Inmiddels werkt hij al weer een paar jaar bij de Kansspelautoriteit, waar hij als senior handhavingsjurist adviseert bij het toezicht op en de handhaving van het verbod op online kansspelaanbod. Daarnaast is hij Functionaris voor de Gegevensbescherming bij de Kansspelautoriteit.
(Liefhebbers van klassieke muziek kunnen Lourens op woensdag 12 april 2017 13-13.30 horen spelen bij de inloopconcerten in het Groot Auditorium van het Academiegebouw in Leiden.)

My interest, recently, was sparked by the hacking state. More often than not states do not just passively collect intelligence, they seem, increasingly, to be employing network based attack strategies to break in and retrieve information. Other sates – it is suspected, to say the least – readily resort to the use of hacking as a means to distort infrastructure in another state.
The questions this raises for international law are numerous, but it all begins with a base line. That is: if a state actor uses relatively anonymous means to distort or access information in an other state: which responsibility does the state where the attack originates have? And in practical terms: how can this even be determined?

The major question is twofold: what are the due dilligence requirements of states in international law (also in relation to evidence gathering). And what could be the norms for states in such conflicts? Could this start a war? I hope not (and so do others)!

In light of this ongoing debate, I thought it was useful to post a link to a number of articles I was reading on this – for your elaw enjoyment. They are linked in the text above. Perhaps a next step would be to open a forum discussion on this topic: the more elaw enjoyment, the better, don’t you agree?
